Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Escalera Labs S.L. ("EchoDeck", "we", "us", "our") regarding your use of the EchoDeck desktop application, the echodeck.ai website, and all related services (collectively, "EchoDeck Products").

By downloading, installing, or using any EchoDeck Product, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use EchoDeck Products.

2. Description of Service

EchoDeck is an AI-powered soundboard application for gamers, streamers, and creators. EchoDeck Products include:

  • [→] EchoDeck Desktop App — native application for Windows and macOS providing AI-powered soundboard, context-aware audio triggers, clip capture, voice personas, and TTS
  • [→] EchoDeck Website — informational website, sound library, account management, and subscription billing
  • [→] Cloud AI Services — optional cloud-based transcription, context analysis, and TTS via third-party providers (OpenAI, ElevenLabs, Groq)
  • [→] Local AI Services — optional on-device AI inference (Whisper, local LLM, Chatterbox TTS) for privacy-first users

3. Age Requirements

You must be at least 16 years old to use EchoDeck Products. If you are between 16 and the age of legal majority in your jurisdiction, your parent or legal guardian must read and accept these Terms on your behalf and is responsible for your use of EchoDeck Products.

We do not knowingly collect personal information from individuals under 16. If you believe a child under 16 has provided us with personal information, contact us at legal@echodeck.ai.

4. Account & Subscriptions

You may create an account using your email address or through third-party OAuth providers (Google, Discord). Your account is personal — you may not transfer, lend, or share it.

EchoDeck offers multiple tiers: Free, Pro (monthly subscription), and Local Pack (one-time purchase). Paid subscriptions are processed through Stripe. Pro subscriptions can be cancelled at any time — you retain access until the end of your billing period. The Local Pack license is perpetual and does not expire.

We reserve the right to modify pricing with reasonable notice. Existing subscribers will be notified before any pricing changes affect their active subscription.

5. License Grant

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable, worldwide license to download, install, and use EchoDeck Products for personal use. This license does not transfer ownership of any intellectual property.

You may:

  • [✓] Use EchoDeck for personal entertainment, gaming, streaming, and content creation
  • [✓] Monetize content created using EchoDeck (streaming, YouTube, TikTok, etc.)
  • [✓] Import your own sounds, audio files, and TTS voices
  • [✓] Use your own API keys (BYOK) for third-party AI services

You may not:

  • [✗] Reverse engineer, decompile, or disassemble EchoDeck software
  • [✗] Sell, rent, lease, sublicense, or distribute EchoDeck
  • [✗] Use EchoDeck to develop a competing product
  • [✗] Remove or alter any proprietary notices or marks

6. User Content & Sound Library

You may import your own sounds, audio clips, and voice recordings into EchoDeck ("User Content"). Your User Content remains your property — we claim no ownership over it. However, you are solely responsible for the legality and appropriateness of all User Content you use with EchoDeck.

Your responsibilities:

  • [→] You must have the rights to any audio content you import
  • [→] You may not use copyrighted audio without appropriate licenses
  • [→] Voice personas using AI TTS must comply with the AI provider's terms of service
  • [→] You may not use EchoDeck TTS to create non-consensual voice clones of real people

7. Acceptable Use Policy

You agree not to use EchoDeck Products to:

  • [✗] Harass or threaten: Play sounds or use voice personas to harass, stalk, intimidate, or abuse other players or individuals
  • [✗] Impersonate: Use AI voice features to impersonate real people with intent to deceive or harm
  • [✗] Distribute harmful content: Play or generate audio that is threatening, abusive, defamatory, obscene, or promotes violence
  • [✗] Violate platform rules: Use EchoDeck in ways that violate the terms of service of games, streaming platforms, or communication apps you use it with
  • [✗] Commit fraud: Use voice modification or TTS for identity theft, phishing, scams, or criminal deception
  • [✗] Interfere with services: Attempt to disrupt, overload, or compromise EchoDeck or its infrastructure
  • [✗] Violate laws: Violate any applicable local, national, or international law or regulation

We reserve the right to suspend or terminate accounts that violate this policy.

8. Third-Party AI Services

EchoDeck integrates with third-party AI services (OpenAI, ElevenLabs, Groq, and others) for cloud-based features. When you use these features, your data is also subject to those providers' terms of service and privacy policies.

If you use the BYOK (Bring Your Own Key) feature, you are responsible for your own API key usage, billing, and compliance with the provider's terms.

9. Open-Source Components

EchoDeck incorporates open-source software components, including but not limited to Sherpa-ONNX, Whisper, and various audio processing libraries. These components are subject to their respective open-source licenses (MIT, Apache 2.0, etc.).

10. Intellectual Property

EchoDeck, echodeck.ai, and all associated branding, design, logos, content, and documentation are the exclusive property of Escalera Labs S.L. All rights not expressly granted in these Terms are reserved.

11. Disclaimer of Warranties

EchoDeck Products are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not warrant that EchoDeck Products will be uninterrupted, error-free, secure, or free of harmful components. EchoDeck is designed for entertainment and content creation — it is not intended for critical, medical, or emergency use.

12. Limitation of Liability

To the maximum extent permitted by law, Escalera Labs S.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of EchoDeck Products. Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or twenty-five euros (€25), whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Escalera Labs S.L. from and against any claims, losses, damages, liabilities, costs, and expenses arising from: (a) your violation of these Terms; (b) your User Content; (c) your use or misuse of EchoDeck Products; (d) your violation of any law or the rights of any third party.

14. Updates & Modifications

We may update EchoDeck at any time, including adding, modifying, or removing features. We may revise these Terms at any time — material changes will be communicated via email or a notice on our website. Continued use after changes constitutes acceptance.

15. Termination

You may stop using EchoDeck at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your license ends immediately. For paid subscribers, refunds are handled per our subscription terms (Section 4).

16. Governing Law

These Terms are governed by the laws of Spain. Disputes shall be submitted to the courts of Valencia, Spain. EU residents additionally enjoy protections afforded by mandatory provisions of their country of residence and may use the EU Online Dispute Resolution platform.
